Wills & Probate

About this section

A will is a legal document detailing what a person decides should be done with their money and property after their death. It is recommended that you have a will to avoid any confusion on how your assets are managed, so your wishes are clear. A solicitor can explain the process and help you draw one up.

Dealing with the affairs of someone after they have died can be a stressful and confusing ordeal. If you make a will, you are able to make provisions for your friends and family, as well as ensuring your wishes are upheld after you have passed away. The articles in this section provide guidance on:

The Facts...

  • You are not required by law to make a will
  • If you die without making a will, your estate will be divided up according to the Administration of Estates Act 1925
  • If a person within a cohabiting couple dies without making a will, their partner is not automatically entitled to inherit any of their property
  • Making a will ensures your family are not going to be liable for more inheritance tax than is necessary
  • You are advised to review your will every five years, or when there is a major change in your life
  • Probate is an official form that gives the executors of the will the right to deal with the assets and property of the deceased person
  • According to a YouGov poll, one in ten adults in the UK have fallen out with a family member over an inheritance
  • A YouGov poll found that 42% of siblings have never spoken to each other again after arguing over a will
  • Half of all Britons have not made a will
