About this section

A divorce is the legal dissolution of a marriage. The terms of such a separation are usually determined by a Court of Law, which may take into account prenuptial or postnuptial agreements or simply confirm terms that the spouses have agreed privately.

However, in such an emotional and stressful time, spouses may disagree on the terms of their divorce, which can lead to expensive litigation.   • Divorce rates are falling amid the recession, with more couples choosing to just separate or continue living together because they can afford to live in separate homes
  • According to Office for National Statistics data, ten per cent of couples who married in 2008 will make it through to their diamond wedding anniversary in 2068
  • Some 45 per cent of these marriages will end in divorce, while a further 45 per cent will experience the death of one of the partners
  • The proportion of marriages expected to end in divorce increased from 34 per cent in 1979 to 45 per cent in 2005
  • In 2001 there were 141,135 divorces in England and Wales, compared with 512 in 1901
